![]() Lakeshore Learning Materials Earth Day Contest Terms & Conditions OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN. OFFER VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Please read these rules before entering the Lakeshore Learning Materials Earth Day Contest. By submitting an entry, you agree to be bound by these rules and you represent that you satisfy eligibility requirements. 1. Eligibility. NO PURCHASE NECESSARY TO ENTER TO WIN. THE CONTEST IS ONLY OPEN TO RESIDENTS OF THE UNITED STATES, INCLUDING THE DISTRICT OF COLUMBIA, OVER THE AGE OF 18. Employees and other representatives of Lakeshore Learning Materials (The Sponsor) and affiliates (and the family members living in the same household of each) are not eligible to win. Offer void where prohibited or restricted by law. 2. How to Enter. Fill out the following form located at the Lakeshore Learning Materials website (http://www.lakeshorelearning.com/general_content/free_resources/earthDayContest2009.jsp), or send your activity ideas to Lakeshore Learning Materials, 2695 E. Dominguez St., Carson, CA 90895. Winners will be chosen on or around March 23, 2009. The Sponsor is not responsible for lost, late, or illegible entries. All entries become property of the Sponsor and will not be returned or acknowledged. 3. Entry Materials. Entrants represent and warrant that their Submission is their original work, it has not been copied from others, and it does not violate the rights of any other person or entry. All entry materials become the property of the Sponsor and will not be acknowledged or returned. Entry in this Contest constitutes entrant’s irrevocable, perpetual permission and consent, without further compensation or attribution, to use the Submission and the entrant’s name and city and state for editorial, advertising, commercial and publicity purposes by the Sponsor and/or others authorized by the Sponsor. Sponsor and/or others authorized by the Sponsor shall have the right to edit, adapt, and modify the Submission. In addition, a Submission shall be deemed to be a work-made-for-hire owned by the Sponsors under the copyright laws of the United States, and submission of an entry shall constitute and be deemed to be the entrant’s irrevocable consent to transfer and assign all rights, title and interest in a Submission to the Sponsor, including but not limited to the copyright, and renewal rights worldwide, and to execute all documents and take all actions deemed reasonably necessary by Sponsor to effect, record, and perfect any requested assignment. Each entrant releases and discharges the Sponsor, the judges, any party associated with the development or administration of the Contest, their employees, agents, or representatives, or any of their parents, subsidiaries, sister companies, or affiliates from any and all liability in connection with the Contest, including without limitation, legal claims, costs, injuries, losses or damages, demand or actions of any kind. 4. Photograph Copyright/Use Rights. Entries must be submitted by the original photographer. Do not submit a photo taken by someone other than yourself. Entrant must be the sole owner of the copyright of any image submitted. Submission of the photo and entry form is your guarantee that you are the author and copyright holder of the photo. Entrants retain the copyright to their photographs. By entering the contest, entrants grant Sponsor a royalty-free, world-wide, perpetual, non-exclusive license to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any purpose including, but not limited to advertising and promotion of the website and commercial products. Photographs may appear on Sponsor’s website. Any photograph reproduced will include a photographer credit. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such uses. For a photo in which a person is recognizable, you must secure a model release from the subject or, in the case of a minor, the permission of the subject’s parent or guardian, and provide it to the Sponsor upon request. A sample release is available at http://www.lakeshorelearning.com/media/images/pdfs/ModelReleaseForm.pdf. 5. Prizes. A total of 3 prizes will be awarded, each consisting of a gift certificate for the purchase of products with the Sponsor as follows: (a) One grand prize consisting of a $150 gift certificate, (b) One first runner-up prize consisting of a $100 gift certificate, and (c) One runner-up prize consisting of a $50 gift certificate. ALL INCOME OR OTHER TAXES, IF ANY, ASSOCIATED WITH THE RECEIPT OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. All prizes shall be awarded. No substitution or transfer of prizes shall be allowed, except by the Sponsor, in which case a prize of equal or greater value will be substituted. The odds of winning a prize will be determined by the number of eligible entrants at the time of each drawing. Only one prize will be awarded to each person or entrant. 6. Selection of Winners. Winners will be selected by a member or members of the Research & Development department staff of Lakeshore Learning Materials (the “Judge(s)”). In the event two or more valid entries contain the identical Submission and are selected as winners, the Judge(s) will draw the winner by random selection. All decisions of the Judge(s) are final and binding. Three gift certificate winners will be selected on or around March 23, 2009. Winners will be notified by e-mail and gift certificates will be sent to the winners via e-mail. A valid e-mail address will be required in order for the Sponsor to send the gift certificate to a winner. If a winner did not supply a valid e-mail address at time of entry, an alternate winner may be selected, at the sole discretion of the Judge(s). If the winner is unreachable or ineligible or fails to claim their prize within five (5) business days, an alternate winner may be selected, at the sole discretion of the Judge(s). By accepting a prize, each winner further releases the Sponsor and related affiliates and related companies from any and all liability, loss, or damage of any kind arising out of or in connection with such winner's participation in the Contest or with respect to awarding, receipt, possession, use or misuse of any prize, or to participating in the Contest or any prize-related activities. 7. Limitation of Liability. The Sponsor, its affiliates, and their respected representatives are not responsible or liable for any entry or other communication which is lost, late, damaged, misdirected, illegible, incomplete, postage-due, mutilated, or stolen. If, for any reason (including without limitation, tampering, fraud, technical failures, or any causes beyond the control of the Sponsor), the Contest cannot be conducted as planned, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Contest. 8. General Release. By entering the Contest, each entrant releases each Released party from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including without limitation, claims, costs, injuries, or losses related to personal injuries, death, damages to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). 9. Consent. Unless prohibited by applicable law, by entering the Contest, the Entrants consent to the use of their name, likeness and image, address, prize information, and/or entry for promotional and other purposes without further compensation, except where prohibited by law. Unless prohibited by applicable law, by entering the Contest, entrants consent to being placed on the Sponsor's mailing list and give their express permission to be contacted by the Sponsor by e-mail, telephone, and/or postal mail. A copy of the Sponsor's privacy policy is available online at http://www.lakeshorelearning.com. By entering the Contest, entrants agree that they have read the Sponsor's privacy policy and consent to its provisions. 10. Miscellaneous. Entrants agree to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects. The Sponsor reserves the right to change these Official Rules, or cancel the Contest at any time, in its sole discretion.
